Four days after SC order, surety papers keep Gautam Navlakha in jail | India News


MUMBAI: Advocating for Activists Gautam Navlakha recently told the special NIA court that the Navi Mumbai police commissioner’s office refused to accept a draft claim worth Rs 2.4 lakh which they had provided under a order of the supreme court allow him to be placed under house arrest in Elgar Parish case.
Advocate Chandni Chawla forwarded the plea before the special trial court on Monday asking the police commissioner to accept the draft request. “Please give notice to non-filer 2, i.e. police commissioner, Navi Mumbai,” said NIA special judge RJ Katariya.
Special Prosecutor Prakash Shetty stated that he represented the NIA but not the police commissioner and wanted time to file a statement. Court granted time until Tuesday.
In an order last week, SC imposed several conditions. the court said Navlakha (69) will have to pay Rs 2.4 lakh for expenses incurred for the deployment of police officers outside his home in Navi Mumbai. He was also directed to provide a guarantee of Rs 2 lakh.
Navlakha’s attorney informed the special NIA court that the registrar’s assistant had objected that the guarantor had failed to provide a certificate of ability to pay and a ration card or an affidavit. The defense submits that it will take at least a month to obtain a certificate of insolvency and prays that the surety may be temporarily admissible until the certificate of insolvency is submitted.
It has also been suggested that the penal manual stipulates that the presentation of a certificate of solvency from the collection agency is not always necessary and can only be requested in suspicious cases. suspicions and cases involving large amounts of money.
The court said that since a guarantee of Rs 2 lakh will be provided, it is necessary to provide the ability to pay. “The defendant’s defense prayed for temporary acceptance of the solvency, in such a situation where prosecution is required so also a verification report of the guarantor through the NIA is required.” special judge said. The court directed the prosecution to give its voice. “The NIA will verify on the warrant and provide a report on the same,” the judge said.
